And on the other hand, the User - Client (hereinafter the User), registered on the website by means of a username and password, for which he/she has full responsibility of use and custody, being responsible for the veracity of the personal data provided to the provider.

BOTH ACCEPT this document, and implies that the user:

  1. That he/she has read and accepts these general conditions of purchase from the moment he/she acquires any of the products offered.
  2. That he/she is of legal age and has sufficient capacity to contract.
  3. That he/she assumes all the obligations set forth herein.

2. PURPOSE OF THE CONTRACT:

3. INFORMATION PROVIDED ON THE WEBSITE www.grupoorbital.es:

3.1 Publication of prices: Exceptionally, the prices of the products shown on our website may be specified erroneously and show a lower price than the corresponding price. When this happens, and if we have confirmed your order, we will contact you immediately in order to issue a new order confirmation with the correct price. In the event that the correct price is higher, you may cancel your order and we will refund any amount you have already paid.

All contractual information on the website is shown in Spanish (Castilian) and communication with customers and users, as well as the formalisation of the contract, will be carried out in this language, although, if the customer so wishes, it may be done in another language, always indicating this before initiating the contracting procedure.

3.4 Right of Cancellation: Orbital Telefonía y Equipos S.L. reserves this action (right of cancellation) of the shipment of a determined product that does not fulfil the quality requirements imposed to all the products of www.grupoorbital.es. In the case that this lack of quality is detected, the Customer Service of Orbital Telefonía y Equipos S.L. will suggest a replacement product and, if the replacement is not to the client's liking, the cost of the product will be refunded.

3.5 Orders 24h, every day of the year: The schedule of reception of orders is of twenty-four (24) hours the three hundred and sixty-five (365) days of the year, although orders made after nineteen 19 hours will not be processed, remaining for the following working day in Santa Cruz de Bezana (Cantabria). Orders received during the weekend will be processed first thing on the following Monday, or the first working day.

3.6 Fraud: If Orbital Telefonía y Equipos S.L. suspects or detects any anomaly or fraud, it reserves the right to cancel the transaction for security reasons.

4. PURCHASE PROCEDURE:

In order to access the products offered by the provider, the user must register through the website by creating a user account. 5. SHIPMENT:

Shipments will be made through the MRW Company, whose Customer Service telephone number is 902 300 400. Shipping costs will be applied as follows:

The delivery time is usually between 2 working days, depending on the destination town and the chosen payment method. This term is understood as long as the availability of the goods has been confirmed and full payment of the order has been verified.

Provider shall not assume any liability if the delivery of the product or service does not take place due to false, inaccurate or incomplete information provided by the user.

Delivery shall be deemed to have been made when the carrier has placed the products at the disposal of the user and the user, or the user's delegate, has signed the delivery receipt document.

It is the User's responsibility to check the products on receipt and to state any reservations and complaints that may be justified in the delivery receipt document.

In the event that the contract does not involve the physical delivery of any product, these being directly downloaded from the website, the provider will previously inform the user regarding the procedure to be followed for this download.

6. PRICES AND TERMS OF VALIDITY OF THE OFFERS:

All prices displayed in the shop www.grupoorbital.es include the VAT in force at the time of purchase. All prices shown on the website are valid except for typographical errors or out of stock and in any case will be expressed in Euro currency (€). These costs, unless expressly stated otherwise, do not include the costs of shipping, handling, packaging, shipping insurance or any other additional services and annexes to the product or service purchased. (VALUE ADDED TAX: In accordance with the provisions of Article 68 of Law 37/1992 of 28 December on Value Added Tax, the delivery of products or services shall be deemed to be located in the territory of application of Spanish VAT if the delivery address is in Spanish territory except for the Canary Islands, Ceuta and Melilla. The applicable VAT rate will be that legally in force at any given time depending on the specific article in question. The prices applicable to each product will be those published on the website and automatically applied by the contracting process in the last phase of the same. The client assumes that, in any case, the economic valuation of some of the products may vary in real time. In any case, this will always be communicated to users beforehand.

In the case of promotions of limited duration, the discount of the promotion will be applied as long as the order has been registered during the promotion period.

The data recorded by the different payment methods constitutes proof of the date on which the financial transactions were made and will be used to determine whether or not the order is subject to promotion.

7. PAYMENT METHODS:

Below we detail the systems available:

7.1 Payment by credit or debit card: The user must have a valid credit or debit card, where all the digits of the card number must be specified in the corresponding form. The transaction is formalised at the time of placing the order. Only Visa and Mastercard are accepted. Only secure card payments are accepted where your identity as the cardholder is authenticated in accordance with the method established by your bank, via secure e-commerce ("Verified by Visa" and "MasterCard SecureCode"). The order cannot be taken into account and will not be processed until the payment has been authorised by your bank or cashier.

8. DELIVERY OF ORDERS:

8.1 Delivery Address: Orders will be delivered to the delivery address freely designated by the user. 8.2 Delivery times: They correspond to those fixed in the file of each product. In the case of products not available at the time of purchase, our Customer Service can provide you with information on availability and a delivery time.

If you have ordered several products in the same order, please note that they may have different availability dates, in which case you may receive them on different dates. Please note that if any of the references are not available at the time of shipment, you have the right to cancel the order at any time before shipment by contacting our Customer Service via the following email address: admin@grupoorbital.es indicating the order number.

8.3 Confirmation of shipment: When the order is delivered to our carrier, we will send you confirmation of shipment to the e-mail address you provided when placing the order. In the shipping confirmation we will indicate the corresponding tracking number so that you can track it through our carrier's website.

8.4 Delivery damage: The products are delivered in secure packaging. If at the time of delivery, without the need to manipulate the shipping packaging or the product itself, it is clearly and visibly apparent that a product has defects caused by damage caused by transport or, in the same way, an error is apparent in the goods received, the customer must detail this fact in the delivery note, the customer must detail this fact on the receipt signed by the carrier and immediately contact our Customer Service line 942 941 173 or email admin@grupoorbital.es within 24 hours of receipt, in order to request the return of the product or products affected and proceed to replace them with another in optimal conditions or refund the price paid for the same, as indicated in that email.

A proof of delivery without any signs of damage is equivalent to a product with the packaging in perfect condition. Likewise, if damage to the product is detected once the package has been opened while the packaging is in perfect condition, the customer has 24 hours from receipt to contact our Customer Service line 942 941 173 or email admin@grupoorbital.es. After 24 hours of delivery no claims for damage to the product will be accepted.

9. RIGHT OF WITHDRAWAL:

9.1 Right of withdrawal: the User has 14 calendar days, counted from the date of the product, to return the product (art. 71 Law 3/2014 of 27 March). If you are not satisfied with the product or any of the products in your order, you may exercise your right of withdrawal by filling in the form attached to these conditions, with your order number (to obtain a refund of the amount of the product(s) within a maximum period of fourteen (14) calendar days following receipt of the order) along with your contact details. Unless the return is made due to defects in the product, the shipping costs will be borne by the USER. The product must be returned in its original packaging and in perfect condition.

We will provide you with a return number and instructions for the return procedure. You must send it to us by email ayuda@soymovil.es or by post, always within 14 calendar days of receipt of the order. After this period, you may only request the return or exchange of the product(s) for technical reasons subject to the guarantee of said product(s).

You must return the product with all the elements with which it was delivered, without damage or marks of wear of any kind, and that does not denote an inappropriate use of the good or different from the nature of the same to the address we have provided.

It is advisable to return the product in its original packaging. If this is not possible, the product will suffer a depreciation in value. The customer will be responsible for the packaging and protection of the product(s) he/she sends as well as the costs derived from the shipment.

Provided that the products are returned within 14 calendar days, without damage or marks of wear and tear and complying with the requirements set out in this section, with the return number that we will have provided, we will refund the full amount of the purchase.

Remember that in any case the product must include:

  • Return number provided
  • Order number
  • Date of purchase and date of exercise of the right of withdrawal.

9.2 Return of defective product: The user will have to inform Orbital Telefonía y Equipos S.L. of the lack of conformity with the product in the term of two months since he/she had knowledge of it. In the case that the product is defective of origin, it has to send an email to admin@grupoorbital.es with the number of order and explaining the reason of the return. Our Customer Service Department will contact you by email or phone call telling you how to proceed with the return of the defective product and providing you with a return number.

The product(s) of the order must be returned to the address that we will provide you with all the elements with which it was delivered in perfect condition, without damage or marks that denote an inappropriate use of the good or different to the nature of the same.

Once the defective product is received in compliance with these requirements and it is verified that the product/s have a manufacturing defect, we will contact you to arrange the repair, replacement, discount or termination of the contract. In any of the previous cases the derived expenses will run in charge of Orbital Telefonía y Equipos S.L.

9.3 Return of not defective product: Orbital Telefonía y Equipos S.L.l. the product does not have any defect and its return has been motivated by ignorance or bad use, Orbital Telefonía y Equipos S.L. will get in touch with you to indicate the steps to follow for the recovery of the product.

The expenses of shipment derived from the return of a product that does not present defect or defect some to the user will run at the expense of the client and Orbital Telefonía y Equipos S.L. will not proceed to this shipment until having received the payment in advance of the costs of transport. The verification on the part of Orbital Telefonía y Equipos S.L. that the product fruit of the return presents flaws derived from a bad use or deficient protection during the shipment can suppose the cancellation of the Guarantee or cause decrease of the value of the product.

9.4 Return for error in the order on the part of Orbital Telefonía y Equipos S.L.: When the product does not correspond to the one of the order, due to some error attributable to the company, the user will have to communicate it by mail to the company as soon as possible; Orbital Telefonía y Equipos S.L. will run with the expenses of collection of the product sent by error and delivery of the corresponding one to the one of the realized order.

9.5 Verification of the Returns: The verification and checking of the products object of return will run in charge of Orbital Telefonía y Equipos S.L. that, once in its facilities, will verify that they are received fulfilling all the requirements established in the section 9.1. The non fulfilment of these requirements can suppose the cancellation of the Guarantee or cause decrease of the value of the product.

In the event that any of the elements are missing, the product will be returned to your home with a note indicating the missing content.

9.6 The right of withdrawal shall not apply in the following cases:

  1. If the product is not presented in perfect condition.
  2. If the packaging of the product is not the original packaging or is not in perfect condition. The original packaging must protect the product so that it is received in perfect condition, and the use of seals and adhesive tapes applied directly to it is prohibited.
  3. When the product is open without being able to prove that it has not been used. In software applications that are directly downloaded through the portal.
  4. En las aplicaciones de software que sean directamente descargadas a través del portal.
  5. Cuando sean productos personalizados o aquellos, que por razones de higiene u otras excepciones legalmente previstas, no sean susceptibles de este derecho.

10. REINTEGROS

10.1 Reintegro de los gastos de envío: Si solicita el reintegro de los gastos de envío de la devolución deberá enviar los productos por correo estándar (carta ordinaria). La responsabilidad del envío recae exclusivamente en la empresa de transporte o medio contratado para dicho envío. Los gastos extra derivados de la contratación de servicios de entrega rápida correrán a cargo del cliente.

10.2 Reembolso por devolución: Para el caso de devolución, el reembolso de los importes pagados se efectuará a través del medio de pago que se utilizó en la compra. Orbital Telefonía y Equipos S.L. no devolverá el importe o realizará ningún reenvío de mercancía mientras no se haya verificado la recepción y estado de embalaje y accesorios del producto objeto de la devolución o cambio en nuestro almacén.

10.3 Plazo de Reembolso: el reembolso se efectuará en un plazo de 15 días hábiles desde la recepción y verificación de las condiciones de la recepción del envío. El plazo máximo para realizar el pago establecido es de un mes. Para proceder al reintegro deberá darnos los siguientes datos:

– nº de devolución

– nº de factura y pedido

– IBAN + 20 dígitos de su cuenta bancaria.

10.4 Orbital Telefonía y Equipos S.L. declina el reintegro de las cantidades si:

– los productos están usados o deteriorados, o su uso ha excedido a su naturaleza.

– a los productos les falta algún elemento.

11. GARANTÍAS APLICABLES Y SERVICIOS POSTVENTA:

11.1 Garantía: Todos los productos ofertados a través del sitio web son completamente originales, salvo que se indique lo contrario en su descripción.

Todos los productos cuentan con un periodo de garantía de 2 años, conforme a los criterios y condiciones descritas en el Ley 3/2014, de 27 de marzo, por el que se aprueba el texto refundido de la Ley General para la Defensa de los Consumidores y Usuarios y otras leyes complementaria, salvo casos excepcionales en los que puede ser de distinta duración.

En caso de que la Ley de Garantías de Venta de bienes de consumo (23/2003, de 10 de Julio) establezca que el producto debe ser enviado al fabricante para gestionar dicha garantía,  el equipo de Orbital Telefonía y Equipos S.L. le indicará cómo proceder a través de correo electrónico o llamada telefónica. En estos casos, Orbital Telefonía y Equipos S.L. no se hace responsable de cómo el fabricante tramita la garantía de dicho producto.

  1. Salvo prueba en contrario, se entenderá que los productos son conformes con el contrato siempre que cumplan todos los requisitos que se expresan a continuación, salvo que por las circunstancias del caso alguno de ellos no resulte aplicable:
    1. Se ajusten a la descripción realizada por Orbital Telefonía y Equipos S.L.
    2. Sean aptos para los usos a que ordinariamente se destinen los productos del mismo tipo.
    3. Sean aptos para cualquier uso especial requerido por el cliente cuando lo haya puesto en conocimiento de  Orbital Telefonía y Equipos S.L. en el momento de la celebración del contrato, siempre que éste haya admitido que el producto es apto para este uso,
    4. Presenten la calidad y prestaciones habituales de un producto del mismo tipo que el cliente pueda fundadamente esperar, habida cuenta de la naturaleza de éste y, en su caso, de las descripciones sobre las características concretas de los productos hechas por Orbital Telefonía y Equipos S.L.
    5. Orbital Telefonía y Equipos S.L. describe los detalles, las características técnicas y las fotografías de los productos facilitados por el fabricante de los mismos, de manera que no queda obligado por estas declaraciones públicas.
  1. La falta de conformidad que resulte de una incorrecta instalación del producto se equiparará a la falta de conformidad del mismo cuando la instalación esté incluida en el contrato de compraventa y haya sido realizada por Orbital Telefonía y Equipos S.L. o bajo su responsabilidad, o por el USUARIO cuando la instalación defectuosa se deba a un error en las instrucciones de instalación.
  2. No procederá la responsabilidad por faltas de conformidad que el Usuario conozca o no haya podido ignorar en el momento de la celebración del contrato o que tengan su origen en materiales suministrados por el Usuario.

11.2 Productos defectuosos: En caso de producto defectuoso, Orbital Telefonía y Equipos S.L. deberá proceder a la reparación, sustitución, rebaja del precio o resolución del contrato (según corresponda), gestiones que serán gratuitas para el usuario. Orbital Telefonía y Equipos S.L. responde de las faltas de conformidad que se manifiesten en un plazo de dos años desde la entrega, siempre y cuando informe a Orbital Telefonía y Equipos S.L. de la falta de conformidad en el plazo de dos meses desde que tuvo conocimiento de ella.

11.3 Supuestos de anulación de garantía: La garantía no se aplica en los supuestos siguientes:

  •  Deterioro creado por adaptaciones, ajustes o modificaciones realizadas sobre un producto sin acuerdo escrito con el fabricante,
  • Gastos relativos al mantenimiento, reparación o cambio por piezas por desgaste normal,
  • Averías y deterioro de accesorios,
  • Deterioro creado por una mala utilización del producto, uso inapropiado, no respeto hacia las instrucciones de uso en lo que respecta a su utilización y mantenimiento o una instalación inapropiada,
  • Daños generados por personas no acreditadas o el usuario,
  • Daños causados por accidentes, rayos, inundaciones, incendios o cualquier otra causa que no sea responsabilidad del fabricante,
  • Daños causados por un fallo del sistema en el que el producto pueda estar incorporado,
  • Si el modelo o el número de serie del producto muestren alguna modificación,
  • Uso del producto fuera del marco familiar y privado, por ejemplo en el uso profesional intensivo, o
  • Productos ya reparados por Servicios de Reparación ajenos a Orbital Telefonía y Equipos S.L.

11.4 Sustitución de un producto irreparable: En el caso de que el producto sea considerado irreparable o el coste de la reparación sea desproporcionado respecto a su valor, se sustituirá por otro exactamente igual. De no ser posible esto último, le ofreceremos un producto de características idénticas o superiores.

La sustitución de su producto dará por concluido su contrato de compraventa y extensiones de garantía si las hubiera, ya que al adquirir su nuevo producto éste se beneficiará de un nuevo contrato al tratarse de una nueva compra.

12. RESOLUCIÓN DE LITIGIOS EN LÍNEA (ONLINE DISPUTE RESOLUTION)

Conforme al Art. 14.1 del Reglamento (UE) 524/2013, la Comisión Europea facilita una plataforma de acceso gratuito para la resolución de conflictos online entre el USUARIO y el PRESTADOR, sin necesidad de recurrir a los tribunales de justicia, mediante la intervención de un tercero, llamado Organismo de resolución de litigios, que actúa de intermediario entre ambos. Este organismo es neutral y dialogará con ambas partes para lograr un acuerdo, pudiendo finalmente sugerir y/o imponer una solución al conflicto. 13. NULIDAD E INEFICACIA DE LAS CLAUSULAS:

Si cualquier cláusula incluida en estas Condiciones Generales fuese declarada, total o parcialmente, nula o ineficaz, tal nulidad o ineficacia afectará tan sólo a dicha disposición o a la parte de la misma que resulte nula o ineficaz, subsistiendo las Condiciones Generales en todo lo demás, teniéndose tal disposición, o la parte de la misma que resultase afectada, por no puesta.

14. LEY APLICABLE Y JURISDICCIÓN:

Estas condiciones se regirán o interpretarán conforme a la legislación española en aquello que no esté expresamente establecido. El prestador y el usuario, acuerdan someter cualquier controversia que pudiera suscitarse de la prestación de los productos o servicios objeto de éstas Condiciones, a los Juzgados y Tribunales del domicilio del prestador (si es persona jurídica) o del usuario (si es persona física).

En el caso de que el usuario tenga su domicilio fuera de España, el prestador y el usuario, renuncian expresamente a cualquier otro foro, sometiéndose a los Juzgados y Tribunales de la ciudad de Santander (España).
